Weeping Water Nebraska




OCTOBER 9, 2017


Mayor Michael Barrett called the monthly meeting of the Weeping Water City Council to order at 6:00 p.m., on October 9, 2017 at City Hall with the following members of the council answering roll:  Ray Frew, Kelly Nutter and Timron Gilfert.  Absent:  Lawrence Mozena.  Notice of the meeting was given in advance thereof by publication in the October 5, 2017 edition of the Plattsmouth Journal.  The posted location of the Open Meetings Act was noted by the Mayor.  Motion by Nutter, seconded by Gilfert to approve the minutes of the September 11, 2017 public hearings and meeting as presented.  Motion carried with all members of the council voting aye.  Absent:  Mozena.

No one spoke during Open Forum.

Monthly Reports:  Fire-One call for the month.  It was noted by Chief Ervin that this week is Fire Prevention week, with the department having some activities scheduled for the elementary students.  It was noted that although there is no state law regarding the length of time bunker gear can be used, the department will try to rotate out any bunker gear that is older than ten years.  Rescue-Assistant Chief Justina Barnhart gave the rescue report noting there were 10 calls for the month.  The department has drawn up new By-Laws and Standard Operating Procedures, which the council will review and vote on at the November council meeting.  Kurt Powles and Bruce Sorensen gave the Maintenance Report and Water/Wastewater reports respectively.  It was noted that the water well project has now been completed.  Health Board-Updates on property concerns were noted.

Old Business-Motion by Nutter, seconded by Frew to pass Resolution 17-09 that approves a tobacco free policy for some outdoor recreational facilities.  Motion passed with Nutter, Gilfert and Frew voting aye.  Nays:  None.  Absent:  Mozena.

Issues pertaining to the Vogler Addition will continue to be pursued.

Motion by Frew, seconded by Nutter to introduce by title only and suspend the three required statutory readings of:


AN ORDINANCE OF THE CITY OF WEEPING WATER, CASS COUNTY, NEBRASKA AMENDING TITLE IX:  HEALTH AND SAFETY, CHAPTER 91:  NUISANCES, REGARDING NUISANCE PROPERTIES INVOLVING BUILDING AND STRUCTURE CONDITIONS, WEEDS AND WORTHLESS VEGETATION, GRASS OF EXCESSIVE HEIGHT, STAGNANT WATER, AND LITTER; TO REPEAL ALL CONFLICTING ORDINANCES; TO PROVIDE FOR PUBLICATION IN PAMPHLET FORM; AND TO PROVIDE AN EFFECTIVE DATE.  Motion carried with Frew, Nutter and Mayor Barrett voting aye.  Nays:  None.  Abstain:  Gilfert.  Absent:  Mozena.  Motion by Frew, seconded by Nutter to adopt by title only on third and final reading Ordinance No. 635.  Motion carried with Frew, Nutter and Mayor Barrett voting aye.  Nays:  Gilfert.  Absent:  Mozena.

Under New Business-Motion by Frew, seconded by Gilfert to approve a new home rebate to Chris and Lori Stackpole in the amount of $1,649.  Motion carried by unanimous roll call vote of those attending.

It was noted the Nebraska Department of Environmental Quality conducted an inspection of both brush dump sites, with no violations observed.
