ORDINANCE NO. 595

AN ORDINANCE OF THE CITY OF WEEPING WATER, NEBRASKA, AMENDING SECTION 91.30 OF THE WEEPING WATER MUNICIPAL CODE, TO PROVIDE FOR AN OPEN BURNING BAN; TO PROVIDE FOR EXCEPTIONS THERETO; TO PROVIDE FOR REPEAL OF CONFLICTING ORDINANCES OR SECTIONS; TO PROVIDE FOR A DATE UPON WHICH THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF WEEPING WATER, NEBRASKA:

     SECTION 1.  That Section 91.30 of the Weeping Water Municipal Code relating to an open burning ban shall be amended as follows:

          (A)  There shall be an open burning ban on all bonfires, outdoor rubbish fires, and fires for the purpose of clearing land.  The open burning ban shall not apply to the recreational use of fire pits in private residences or at the City Campground.

          (B)  The Fire chief or his or her designee may waive an open burning ban under division (A) of this section for an area under his or her jurisdiction by issuing an open burning permit to a person requesting permission to conduct open burning.  The permit issued by the Fire Chief or his or her designee to a person desiring to conduct open burning shall be in writing, signed by the Fire Chief or his or her designee, and on a form provided by the State Fire Marshall.

          (C)  The Fire Chief may adopt and promulgate rules and regulations listing the conditions acceptable for issuing a permit to conduct open burning under division (B) of this section.

         (D)  The Fire Department may charge a fee not to exceed $10 for each such permit issued.  This fee shall be remitted to the City Council for inclusion in the general funds allocated to the Fire Department.  These funds shall not reduce the tax requirements for the Fire Department.  No such fee shall be collected from any state or political subdivision to which such a permit is issued to conduct open burning under division (B) of this section in the course of that state's or political subdivision's official duties.

     SECTION 2.  All Ordinances or parts of Ordinances passed and approved prior to the passage and approval of this Ordinance and in conflict with this Ordinance are hereby repealed.

     SECTION 3.  This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.
